Legal Battle: Application to exhume Kibaki’s remains for DNA analysis in court

The legal battle over the estate of former President Mwai Kibaki has taken a dramatic turn as efforts to settle the matter outside of court collapse, pushing the case towards a courtroom showdown. Jacob Ochola and an individual known only as JNL, both claiming to be offspring of Kibaki, are seeking recognition and a share of his multibillion-shilling estate, which excludes them according to the former President’s will.

Scheduled for a hearing on June 6th, the High Court will deliberate on an application to exhume Kibaki’s remains for DNA analysis, a pivotal move in determining the legitimacy of Ochola and JNL’s claims. Their argument rests on the assertion that they were sired by the late President, a claim vehemently contested by Kibaki’s acknowledged children—Judy, James Mark, David Kagai, and Anthony Andrew.

Central to the case is the demand for DNA testing, with Ochola and JNL pressing for either sibling or paternity tests to establish their biological relationship to Kibaki. Their plea to the court includes a request for a joint DNA test involving themselves and Kibaki’s acknowledged children, as well as an alternative prayer for the exhumation of Kibaki’s body to collect samples for DNA analysis.

Despite attempts to reach a settlement outside of court, negotiations faltered, prompting the legal escalation. Justice Eric Ogola, presiding over the case, has issued a stern directive for the proceedings to proceed without further delay, setting the stage for a pivotal legal confrontation.
